Longshore And Harbor Workers’ Compensation Act

You are entitled to compensation, medical care, and vocational rehabilitation if you were disabled while working in navigable United States waters, or adjoining areas, used to load, unload, repair, or build vessels.

The LHWCA also provides injured longshore workmen with disability compensation. This amounts to two-thirds of the worker’s weekly salary while he or she recovers. If a longshoreman is permanently disabled, he or she can receive compensation, based on the percentage of disability. If a longshoreman dies in a work-related accident, his or her surviving family members may receive compensation for expenses and lost wages.

Under the LHWCA, an employer does not have to be at fault for the worker to recover benefits. Therefore, there need not be any concern that making a claim under the Act will cause your employer to get in trouble.
